Introduction
This document supplements the information you have already received prior to your treatment day,
including your Client Personal Medical Record, consultation details, and information provided at
www.smptreatment.com.
Please read carefully. By signing, you confirm that you understand the treatment, associated risks,
and policies, and that you agree to proceed with SMP treatment. You may withdraw consent at any
time before the treatment begins, even after signing.
1. Nature of Treatment
– SMP is an elective cosmetic procedure. There is no medical necessity for treatment.
– SMP is a form of tattooing, where pigments are deposited into the dermis layer of the skin.
– Like all tattoos, SMP is permanent and difficult to remove; removal procedures cannot be
guaranteed.
– The pigments used contain natural ingredients (carbon and iron oxide).
2. Risks and Side Effects
– Some discomfort may occur during treatment (rarely pain).
– As with any tattoo procedure, there is a risk of infection, though serious infection is very rare.
– Clients with a history of skin cancer, sun damage, or relevant medical conditions must consult
their physician prior to treatment. A doctor’s note may be required.
– For best results, you must follow all aftercare instructions and attend all follow-up
appointments.
– Interfering with the procedure or missing follow-up sessions may negatively affect results.
3. Cancellations, Deposits & Payments
– Appointment details will be confirmed in advance. Failure to confirm may result in your slot being
reallocated.
– If you cannot attend, you must provide at least 48 hours’ notice.
– Cancellations or reschedules within 48 hours will incur a $500 rebooking fee plus the full
session payment.
– A non-refundable deposit may be required to secure your booking. This deposit is applied
toward your treatment cost.
– Late arrival may reduce treatment time or result in forfeiting your appointment.
– The clinic may occasionally need to cancel or reschedule at short notice. While we will notify you
as soon as possible, no compensation will be provided.

Payment Terms:
– 50% of the quoted treatment cost is payable before your first session.
– Quotes are valid for 12 months from consultation.
4. Treatment Suitability
Each client is assessed for suitability before treatment. If SMP is not recommended, we will explain
why.
5. Liability & Legal Protection
– You are responsible for disclosing all relevant medical details prior to treatment.
– SMP Treatment / Simon Yalniz will not be liable for:
– Issues arising from withheld medical information
– Economic losses (including profit loss)
– Indirect or consequential damages
– Under California law:
– We are not liable for dissatisfaction based on personal preference changes such as pigment
color, density, or hairline design.
– Clients expressly waive claims under California Civil Code §1790 et seq. (Song-Beverly
Consumer Warranty Act) and implied warranties relating to satisfaction, as SMP is a permanent
elective tattoo procedure.
– Nothing in this agreement limits liability where prohibited by law (e.g., willful misconduct, gross
negligence, or personal injury caused by malpractice).
6. Acknowledgements
By signing, I confirm that:
– I understand SMP is a permanent change to my appearance.
– I understand results vary, and additional sessions or maintenance may be required.
– I have disclosed all relevant medical conditions and medications.
– I understand that redness and swelling are normal after treatment, and blistering or crusting
(though rare) may occur.
– I will follow all aftercare instructions, understanding failure to do so may affect results.
– I am over 18 years old and can provide proof of age if required.
– I consent to photographs being taken before, during, and after treatment.
– I consent to the use of these photographs for clinic records and for marketing purposes (social
media, website, promotional materials).
7. Data & Communication Consent
– I consent to the storage and processing of my personal data (including photographs) for the
purpose of providing SMP treatment.
– I agree to receive SMS communications from SMP Treatment / Simon Yalniz regarding my
treatment.
